Event Details

NARM Entertainment Law Conference Series is coming to the City Of Angels.

We’ll bring the country’s top music and media attorneys and copyright and licensing specialists together to discuss the Digital Millennium Copyright Act, iPhone jailbreaking, copyright termination, the First Sale Doctrine, and much more.

We'll conclude the program with a cocktail reception from 5:30-7 PM. The reception is sponsored by Ballard Spahr.

This program is approved for 4 hours of MCLE credit by the State Bar of California.

PRELIMINARY AGENDA

The Digital First Sale Doctrine: Who Owns — or Licenses — Digital Products and Content?
This panel will debate several ongoing cases that may define whether purchasers of games, music and business software are “owners” or merely licensees, and whether the first sale doctrine has any continuing viability.

  • Christian Genetski (Zwillinger Genetski, LLP)
  • Clara Shin (Howard Rice, represents AutoDesk)
  • Joe Gratz (Durie Tangri, represents Augusto)
  • Corynne McSherry (Staff Attorney and Kahle Promise Fellow, Electronic Frontier Foundation)
  • Moderator: Gary Greenstein (Wilson Sonsini)

iPhone Jailbreaking Now Legal!! Does This (or Any Other DMCA Circumvention Decision) Really Matter?
One branch of government approves hacking the iPhone to install unapproved apps, but a court rules that RealNetworks cannot hack DVDs even if a consumer’s unapproved copy is itself copy protected and cannot be further distributed. Do these decisions conflict or can they be aligned; and do they really matter in the real world where hacks are ubiquitous?

  • Sandra Aistars (VP and Associate GC, IP, Time Warner)
  • Jonathan Band (Policy Bandwidth)
  • Steve Metaitz (Mitchell, Silberberg & Knupp)
  • Jack Lerner (USC, Gould School of Law)
  • Moderator: Jonathan Handel (TroyGould)

The Developing Storm of Copyright Termination: Who Wins, Who Loses, and How Will it Really Work?
This panel will discuss the policy rationale underlying copyright termination, the practical challenges and costs of exercising termination rights, and the business opportunities that termination creates.

  • Chris Castle (Christian L. Castle Attorneys)
  • Corey Field (Ballard Spahr, LLP)
  • Moderator: Dawn Chmielewski (Los Angeles Times)

After YouTube and Veoh: Have Courts (or Congress) Failed Creators or Struck the Right Balance?
Prominent lawyers will debate recent judicial decisions interpreting the DMCA’s notice-and-takedown safe harbor, and discuss business, enforcement and legislative options for all stakeholders.

  • Michael Elkin (Winston & Strawn)
  • Russ Frackman (Mitchell, Silberberg & Knupp)
  • Ron Wheeler (Sr. VP, Content Protection, Fox Entertainment Group/News Corporation)
  • Moderator: Jon Healey (Los Angeles Times)

Join us following the program, from 5:30-7 PM for a cocktail reception sponsored by Ballard Spahr.
